Under current law, an alcohol beverage licensee whose license is expired for more than 90 days must apply for a new alcohol beverage license. The bill provides a procedure for an alcohol beverage licensee whose license has been expired for more than 90 days but less than 180 days to apply for a reissued license.
The state or local licensing authority has the sole discretion to determine whether or not to allow a licensee to apply for a reissued license. If the licensee is allowed to apply, the licensee must pay a late application fee and an appropriate fine. After accepting the application, the state or local licensing authority has the sole discretion to determine whether to approve or deny the application.
If the local licensing authority approves the application, the local licensing authority must forward the application to the state licensing authority. The state licensing authority may approve or deny the application.
If the application is denied by either the state or local licensing authority, the licensee may apply for a new alcohol beverage license.
